Terms of Service

These Terms of Service (“Terms”) govern your use of castdiemonds.com, your CASTDIEMONDS membership, and purchases from CASTDIEMONDS LLC (“CASTDIEMONDS,” “we,” “us,” or “our”).

By accessing our website, subscribing, submitting a preorder request, or completing a purchase, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be legally capable of entering into a binding agreement to make a purchase. A minor may use the website or make a purchase only with the involvement and permission of a parent or legal guardian.

You agree to provide accurate, complete, and current information when subscribing, submitting a form, or placing an order.

2. Memberships and Communications

CASTDIEMONDS may offer free website memberships that provide access to newsletters, product announcements, drop information, preorder opportunities, discounts, or member pricing.

Membership does not guarantee:

  • The availability of any product
  • A particular price
  • A preorder allocation
  • The ability to purchase a limited-release product
  • Continued access to a particular promotion

You may unsubscribe from marketing emails at any time. We may still send transactional messages relating to orders, payments, refunds, or customer-support requests.

We may suspend or terminate a membership that is used for fraud, abuse, automated purchasing, resale manipulation, circumvention of quantity limits, or other violations of these Terms.

3. Product Information

We make reasonable efforts to display product descriptions, photographs, condition information, prices, and availability accurately.

However:

  • Colors may appear differently depending on the customer’s screen.
  • Manufacturers may make minor production, packaging, paint, decal, or specification changes.
  • Product images may include manufacturer or promotional photographs.
  • Packaging may have minor factory or shelf wear unless a particular packaging condition is expressly guaranteed.
  • Scale models may contain small parts and may not be suitable for young children.

If an important product detail is material to your purchase, contact us before ordering.

4. Limited Drops and Product Availability

Many CASTDIEMONDS products are sold through limited-time or limited-quantity drops. Adding a product to a cart, opening a payment link, joining a list, or beginning checkout does not reserve the product unless we expressly state otherwise.

Inventory may sell out before checkout is completed. Orders are subject to acceptance and inventory verification.

We may:

  • Establish per-customer, per-household, or per-member quantity limits
  • Cancel duplicate or suspicious orders
  • Cancel orders that circumvent stated limits
  • Correct pricing, inventory, or product-listing errors
  • Refuse or cancel an order when reasonably necessary to prevent fraud or abuse

If we cancel a paid order, we will issue a refund for the amount collected for the canceled item.

5. Preorders and Reservations

A product identified as a “preorder” has not yet arrived or is not yet ready for shipment.

Estimated arrival and shipment dates are estimates rather than guarantees. Manufacturer schedules, distributor allocations, customs processing, transportation problems, and other circumstances may cause delays.

The applicable product page or checkout page will state whether:

  • Payment is collected when the preorder is placed
  • Payment will be collected later
  • The submission is only a nonbinding expression of interest or reservation request

Submitting a no-payment preorder or interest form does not guarantee allocation unless we expressly confirm that allocation in writing.

If we collect payment but later cannot fulfill the preorder, we will cancel the affected item and refund the amount paid for it. Material updates regarding delays or availability may be communicated by email.

6. Prices, Taxes, and Payment

Prices are displayed in U.S. dollars unless otherwise stated.

Applicable charges may include:

  • Product price
  • Shipping and handling
  • Sales tax
  • Other charges clearly disclosed before payment

Payments are processed through Stripe or another payment provider identified at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method.

We may correct an obvious pricing or listing error before shipment. When practical, we will give you the option to accept the corrected price or cancel the affected item for a refund.

7. Promotions and Discounts

Promotions, coupons, member discounts, free-item offers, and special pricing may be subject to:

  • Start and end dates
  • Product restrictions
  • Quantity limits
  • One-time-use limits
  • Membership requirements
  • Minimum purchase requirements
  • Geographic restrictions
  • Other terms disclosed with the promotion

Unless expressly stated otherwise, promotions cannot be combined, exchanged for cash, or retroactively applied to an earlier purchase.

We may cancel or correct a promotion affected by an obvious mistake, technical issue, fraud, or abuse.

8. Shipping and Delivery

Available shipping destinations, shipping methods, and charges are displayed on the website or during checkout.

Customers are responsible for providing a complete and accurate shipping address. Contact us immediately if an address needs to be corrected. We cannot guarantee that an address can be changed after fulfillment begins.

Delivery dates are estimates and may be affected by carrier delays, weather, holidays, customs, or other events outside our direct control.

When tracking indicates a delivery problem, or an order arrives damaged, contact info@castdiemonds.com with the order number and relevant details. We may ask for photographs of:

  • The shipping box
  • Shipping label
  • Packing materials
  • Product and product packaging
  • Any visible damage

For destinations outside the United States, when offered, the recipient is responsible for applicable customs duties, import taxes, brokerage charges, and local requirements unless checkout expressly states otherwise.

9. Cancellations, Returns, and Refunds

Order cancellation

Contact us as soon as possible if you need to cancel an order. We will attempt to accommodate the request, but cancellation is not guaranteed after payment or once processing has begun.

Standard returns

Unless an item is marked “Final Sale,” you may request a return within 14 calendar days after confirmed delivery.

To qualify for a standard return:

  • The item must be unused and unopened.
  • Manufacturer seals, packaging, accessories, and inserts must remain intact.
  • The item must be returned in substantially the same condition in which it was received.
  • You must contact us before sending the return.
  • The item must be packaged securely to prevent return-shipping damage.

The customer is responsible for return-shipping costs for a standard return. Original shipping charges are not refundable unless the return resulted from our error or applicable law requires otherwise.

Damaged, incorrect, or missing items

Please contact us within three calendar days after delivery if an order is damaged, incorrect, incomplete, or materially different from its description.

Include the order number and clear photographs when possible. This reporting period helps us investigate the issue with the shipping carrier or supplier and does not limit rights that cannot legally be waived.

Depending on the circumstances and available inventory, we may offer:

  • A replacement
  • Replacement parts
  • A partial refund
  • A return for a refund
  • Another mutually agreed resolution

Do not discard the product, packaging, shipping box, or packing material until we have completed our review.

Nonreturnable items

The following may not be eligible for a discretionary return unless defective, incorrect, or otherwise required by law:

  • Products clearly marked “Final Sale”
  • Opened or used products
  • Products missing original packaging or accessories
  • Products damaged after delivery
  • Personalized products
  • Gift cards or promotional items with no separate purchase price

Refund processing

Approved refunds are issued to the original payment method. Your bank or payment provider may require additional processing time before the refund appears in your account.

10. Payment Questions and Disputes

Contact info@castdiemonds.com promptly if you do not recognize a charge, have not received an order, or believe there is a problem with a transaction. We will make a reasonable effort to investigate and resolve the issue.

Nothing in these Terms limits any rights you may have under applicable payment-card or consumer-protection laws.

11. Acceptable Use

You may not use our website, forms, membership system, or checkout services to:

  • Violate any law
  • Commit fraud or impersonate another person
  • Use an unauthorized payment method
  • Circumvent purchase or quantity limits
  • Interfere with website security or operation
  • Introduce malicious software
  • Scrape or copy website content through automated means without permission
  • Harass other users or CASTDIEMONDS personnel
  • Submit false chargeback, refund, or delivery claims

12. Intellectual Property

The CASTDIEMONDS name, website design, original photographs, graphics, written content, newsletters, and other original materials are owned by CASTDIEMONDS LLC or used with permission.

You may not reproduce, distribute, modify, commercially exploit, or create derivative works from our original content without prior written permission.

Product names, vehicle names, manufacturer names, logos, and trademarks belong to their respective owners. Their appearance on our website does not imply sponsorship or endorsement unless expressly stated.

Our website may link to Stripe, shipping carriers, social media platforms, marketplaces, manufacturers, and other third-party services.

Those third parties operate under their own terms and policies. CASTDIEMONDS is not responsible for third-party websites or services that we do not control.

14. Disclaimer

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis.

We do not guarantee that:

  • The website will always be uninterrupted or error-free
  • Every limited product will remain available
  • Manufacturer or distributor estimates will be met
  • Product values will increase or remain stable
  • Collectible products are suitable as financial investments

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, CASTDIEMONDS LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or purchase of a product.

For a claim relating to a particular purchase, our total liability will not exceed the amount you paid to CASTDIEMONDS for the product giving rise to the claim, except where applicable law does not permit that limitation.

16. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Any dispute not resolved informally will be handled in a court with appropriate jurisdiction in Washington, except where applicable consumer-protection law gives you the right to bring a claim elsewhere.

17. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted with a revised effective date.

The Terms in effect when an order is placed will generally govern that transaction, except when a change is required by law or mutually agreed upon.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. An unenforceable provision will be interpreted as closely as legally possible to its original purpose.
